UMMARY

The Brazilian National Plan of Rights of Persons with Disabilities of 2011 aimed to implement new initiatives and

intensify already developed actions for the benefit of persons with disabilities. These actions included education, health

care, social inclusion and accessibility

measures.

Regarding inclusive education, measures comprised multifunction and

accessible classroom and transportation, access to technical training, the promotion of accessibility in higher education,

bilingual education, as well as a Continuous Cash Benefit at school. In a four-year period, until 2014, the Plan invested

USD 1.9 billion.

The Brazilian National Plan of Rights of Persons with Disabilities ‘Living without limits’ (Viver sem Limite) was launched

on November 17, 2011 (Presidential Decree No. 7612), with the aim of implementing new initiatives and intensify

already developed actions for the benefit of persons with disabilities.

The Plan was elaborated with the participation of

more than 15 ministries as well as the National Council on the Rights of Persons with Disabilities (CONADE), which

incorporated contributions from civil society.

In July 2015, the Brazilian Law of Inclusion of People with Disabilities was signed by the President that extends various

rights of this population in areas such as health, education (e.g. established

a 10% quota for persons

with disabilities to

study at higher and technical education institutions

),

labor market, sports and leisure. In terms of education, the Law

enshrined in Article 27 that the right to education of people with disabilities is a right to an inclusive education system,

and that it is the Government’s responsibility to develop and implement such system at all levels (Article 28). It also

includes a prohibition of private schools to reject pupils with disabilities.

Among the

bjectives outlined in the Plan’s Decree no. 7612, are ensuring an inclusive education system; guarantee that

public education facilities are accessible for people with disabilities, including through adequate transportation;

increased participation of people with disabilities in the labor market through training and professional qualification;

and promoting access, development and innovation in assistive technology.
